CBI Inquiry and Justice to the Victim Muslims

At the outset we thank you for giving us an appointment with you on July 6th for delegation of the Gopalgarh violence victims, members of the Rajathan Muslim Forum (RMF) and elected members of various local bodies and social activists. We are looking forward of meeting you.
I am attaching documents pertaining to various communal violence in Rajasthan due to deliberate law and order failure, particularly the details of the troubling Gopalgarh Violence resulting into deaths of 10 Muslims and 38 injured and looting/damaging of houses and shops in Gopalgarh in the presence of police, and the subsequent harassment of the victims by the CBI and police.
We believe that the Gopalgarh incident wouldn't have occurred or averted, if the district administration of Jodhpur (for Balesar), Udaipur (for Sarada), Jhalawar (for Manohar Thana), Sawai Madhopur (for infamous Soorwal Kand in which a Muslim SHO was burnt alive in the presence of his senior officers), etc. had taken firm preventive or subsequent punitive actions against officers for their dereliction of duty. It may be underlined that for the first time in independent India Muslims were killed in a mosque and 249 rounds of bullets were fired at a civil crowd. The National Commission for Minorities is also shock at this magnitude of violence targeting exclusively Muslims in a Congress regime. Is this the way to enlarge Congress base among Muslims? Surely, you wouldn't agree.
It is in order to recall an incident recorded in golden letters in history about your illustrious great grand father, Shri Jawahar Lal Nehru, our first PM. When Nehru heard that the Sikhs of a village in Punjab in 1947 conspired to kill all Muslims of the village, he himself went there and warned Sikh elders under a banyan tree: 'Don't kill innocent Muslims, I beg you. However, if one Muslim is hurt/killed, I will have my armed staff to have all of you killed under this very tree!' This grim warning worked. No one Muslim was killed. (Freedom at Midnight by Lappier and Collins; Film: The Last Viceroy). But then Nehru was a spectacular secularist par excellence and humanitarian to the core of his heart. It all depends on intention and will power of political leaders. Gehlot can take a leaf from Nehru's life, since he is also a Gandhian and Nehruvian. But Mrs Sonia Gandhi and you have to remind him firmly of his constitutional obligation to protect life and property of innocent Muslims of Rajasthan. Ethnic biases in administration are unproductive and immoral. To be just in governance is a virtue and rewarding virtue.
We, as the citizen of India, demand the following firm actions so that we retain faith in the avowed secularism of the Congress Party and government of Rajasthan:
1. Returning of the Graveyard Land (Khasra 642) to the Gopalgarh Muslims. The District Collector, Gaurav Goyal, should complete all the formalities immediately and hand over the ownership documents to the Muslims. (Action by DM of Bharatpur)
2. CBI Should Release Innocent Victims in the Jail: Mr Abdul Gani, Jama Masjid Sadr, and his three sons and Mr Illi, another innocent person, now in jail, arrested arbitrarily by CBI to immobilize them for depositing against the accused. (Action by Shri V. Narayanasamy and CBI Director)
3. Charge-sheet, Suspend and Remove from Service all GOR Officials for Dereliction of Duty and for Unidirectional Killings of Innocent Muslims in Gopalgarh and for Violence in other places (Jodhpur, Udaipur, Jhalawar, Sawai Madhopur and Bharatpur) : Eschewing caste and communal political expediency (Muslims vs Meena; Muslims vs Gujjars, Muslims vs Bheel and Muslims vs Malis, etc.) the GoR should charge sheet the DM Krishan Kunal and SP Hinglaj Dan, for dereliction of duty and other officers, namely, ASP Om Prakash Meghwal, Tehsildar Lakshmi Kant Gupta (who fouled the whole record of Khasar 642 belonging to the graveyard), Adhyatam Gautam, SHO Gopalgarh, and all police men of the Thana (for instance, constables Jagdish, Shyam Singh, Pradhan, Lekhraj, Kartar Singh etc who colluded directly and fired targeting Muslims from Vajrvahan 'Armed vehicle', and distributed fire arms to the RSS hoodlums). It was one way affair to kill Muslims. No Gujjar was killed. Only Muslims were killed and grievously injured and their houses looted and damaged. They all should be charged with criminal conspiracy to incite violence and kill Muslims. (Action by: CBI, Chief Secretary, Home Secretary of Rajasthan and the CM of Rajasthan)
4. Arresting and Legal Proceedings against Hindutva Hoodlums: RSS hoodlums who spread the rumor of killing of 20 Gujjars in the Mosque and forced DM/SP to order for fire were, among others, Jawahar Bedam; Girdhari Tiwari, Bhajan Lal Sharma, Madan Mohan Padalwas; Keshir Master; Jawahar Bodoli; Mahveer s/o Lottan Bodoli; manjeet Gulati Sikari; Adv Pramod Sharma, Gopalgarh; Advocate Montu; Dani Gujjar Bhainda; Dr Mohan Singh , Gopalgarh; Lekhraj Saini; Kedar Garg and Badri Garg of Gopalgarh; Man Singh Gujjar s/o Gamandi Singh, Gopalgarh; Bhagwan Singh Penia; Arjun Chirdawal. (Action by CBI and SP Bharatpur)
5. Action Against Unfair CBI Investigation and Role of the IO: CBI should be directed to carry out an impartial investigation. Why the CBI ignored 14 FIRs by Muslim victims and took cognizance of only 5 FIRs by police ignoring GOR and GOI Notifications? We demand the IO of the Inquiry should be charge sheeted for arbitrary actions and he should be immediately replaced by an officer of the rank of IG from a far off state, Mr V Narayanasamy, Minister of State in the PMO should take urgent action in this regard. Arresting victims is travesty of the CBI investigation and justice. (Action by: Shri Narayanasamy and CBI Director)
6. Reasonable Compensations to the Victims for Rehabilitation: Victims of violence and looting should be given adequate compensation for loss of life, property and emotional disorientation destabilizing their worldview about governance and shaking confidence in Secularism of Congress in Rajasthan. The CM should order for payment of compensations from CM Relief Fund or from the salaries of the culprit officers who colluded in killing and not taking preventive measures. An average of Rs. 5-10 for the loss of property and injury and Rs. 15-25 lakh for loss of life should be paid. Governments must learn to bear the cost if it can not save life and property of people due to failure of law and order. (Action by: Chief Minister of Rajasthan)
7. Transfer/Suspension of ALL District Officers Present during the Violence: Till the inquiry is over and charge sheets are filed, ALL responsible/accused officers should be suspended and transferred in far flung districts so that they do not influence witnesses. This is very important for restoration of confidence of the victims. (Action by CS and Home Commissioner and CM)
8. Sanitize Communal Proclivity in Rajasthan Congress and Bureaucracy by Firm Actions and Training: The CM of Rajasthan expected to transcend caste and religious factors while dealing with law and order and impressing upon his bureaucrats that any communal leaning would be firmly dealt with. After all DM and SP are responsible squarely for law and order in their district. DM of Jodhpur, SP and DM of Udaipur, DM of Jhalawar (incidentally it was Krishan Kunal who was also there), SP and DM Sawaimadhopur and SP and DM of Bharatpur should be held responsible even retroactively for violence in their districts. Gopalgarh happened because no corrective and punitive action was taken against officers named herein. (Action by CM of Rajasthan)
9. Muslims of Rajasthan are tired of violence: The Congress Party, particularly Mrs Sonia Gandhi and you, should prevail on Shri Ashok Gehlot to prevent, obviate and curb firmly communal violence by punishing officers colluding in fomenting and allowing communal violence. (Action by: UPA Chairperson and President Congress Party, Chairman Congress Party and CM of Rajasthan).
We feel shattered by these events mentioned above. We shall be highly grateful to you for your kind and prompt interventions. We request you to share our agonies and sufferings with Mrs. Sonia Gandhi and the PM. We shall be grateful indeed.
